Mając na uwadze zapisy art. 13 ust. 1  i 2 Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o danych osobowych), zwanego dalej „RODO”,  poniżej przedstawiamy informacje i  zasady przetwarzania danych osobowych przez Draw Distance Spółka Akcyjna w Krakowie.

Administrator danych

Administratorem Twoich danych osobowych jest spółka Draw Distance S.A. z siedzibą w Krakowie, ul. Cystersów 20a, 31-553 Kraków, mail: contact@drawdistance.dev, telefon: +48 12 346 11 41 (dalej: Draw Distance).

Cel przetwarzania

Twoje dane osobowe będą przetwarzane przez Draw Distance w celu przeprowadzenia procesu bieżących rekrutacji na określone stanowisko pracy w Draw Distance, a w przypadku wyrażenia przez Ciebie wyraźnej i dobrowolnej zgody – także dla potrzeb przyszłych rekrutacji.

Podstawa prawna przetwarzania

Draw Distance przetwarza Twoje dane osobowe na podstawie:

1)     Art. 6 ust. 1 lit.c) RODO w zw. z art. 22¹ Kodeksu Pracy,

2)     Art. 6 ust. 1 lit. a) RODO – (zgoda na przetwarzanie danych osobowych) w przypadku:

a.     złożenia dokumentów aplikacyjnych, zawierających dane osobowe wykraczające poza zakres danych określonych w art. 22¹ Kodeksu Pracy (np. wizerunek, zainteresowania), lub

b.     wyrażenia zgody przez kandydata na przetwarzanie danych osobowych dla potrzeb przyszłych postępowań rekrutacyjnych.

Zakres danych osobowych

Zakres przetwarzanych danych osobowych określa w szczególności art. 22¹ Kodeksu pracy oraz przepisy wykonawcze do Kodeksu Pracy.

Podanie danych w zakresie określonym w art. 22¹ §1Kodeksu pracy i rozporządzeń wykonawczych jest obowiązkowe i konieczne do przeprowadzenia rekrutacji, w pozostałym zakresie podanie danych jest zaś dobrowolne i wymaga wyraźnej zgody kandydata.

Realizacja praw

Posiadasz prawo dostępu do treści swoich danych oraz prawo ich sprostowania lub uzupełnienia,  żądania ich usunięcia w przypadkach przewidzianych prawem, ograniczenia przetwarzania, prawo wniesienia sprzeciwu, co do danych osobowych, których podanie jest dobrowolne, prawo do cofnięcia zgody na ich przetwarzanie w dowolnym momencie bez wpływu na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody wyrażonej przed jej cofnięciem. Wycofanie zgody na przetwarzanie danych dla potrzeb przyszłych rekrutacji po przeprowadzeniu bieżącej rekrutacji będzie oznaczać, że nie zostaniesz uwzględniona/-y w kolejnych procesach rekrutacyjnych.

W celu wykonania praw wymienionych powyżej należy skierować żądanie na adres email: contact@drawdistance.dev, listownie na adres siedziby Draw Distance lub złożyć osobiście w siedzibie Draw Distance. Przed realizacją Twoich uprawnień będziemy musieli potwierdzić Twoją tożsamość w sposób indywidualnie dostosowany do danego żądania.

W przypadku uznania, że przetwarzanie przez Draw Distance Twoich danych osobowych narusza przepisy RODO, przysługuje Ci prawo do wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych, ul. Stawki 2,00-193 Warszawa.

Odbiorcy danych

Odbiorcami Twoich danych osobowych mogą być podmioty, którym Draw Distance powierzyła przetwarzanie danych osobowych na podstawie zawartych umów:

§ firmy serwisujące urządzenia Draw Distance, w których przetwarzane są dane osobowe osób aplikujących
o pracę;

§ dostawcy usług publikacji ogłoszeń o pracę lub dostawcy systemów do zarządzania rekrutacjami (np. pracuj.pl)

§ firmy kurierskie za pośrednictwem, których prowadzona jest korespondencja z kandydatami do pracy.

Twoje dane osobowe nie będą przekazywane do państw znajdujących się poza Europejskim Obszarem Gospodarczym i do organizacji międzynarodowych.

Decyzje podejmowane w sposób zautomatyzowany

Draw Distance nie będzie stosował wobec Ciebie zautomatyzowanego podejmowania decyzji, w tym profilowania.

Okres, przez który dane będą przetwarzane

Twoje dane osobowe będą przetwarzane przez:

·     okres niezbędny do przeprowadzenia procesu rekrutacji lub,

·     okres do momentu wycofania zgody – w przypadku udzielenia zgody na przetwarzanie danych na poczet przyszłych rekrutacji,

·     12 miesięcy od daty zakończenia procesu rekrutacji – w przypadku udzielenia zgody na przetwarzanie danych dla potrzeb przyszłych rekrutacji.

Taking into consideration the provisions of article 13 point 1 and 2 of Regulation (EU) 2016/679 of The European Parliament And of The Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as “GDPR”, below we present information and rules of personal data processing by Draw Distance S.A. with its registered office in Kraków.

Controller of data

The controller of your personal data is Draw Distance S.A., with its registered office in Kraków, Poland, Cystersów 20a street, 31-553 Kraków, e-mail: contact@drawdistance.dev, telephone: +48 12 346 11 41, hereinafter referred to as “Draw Distance”).

Purpose of processing

Draw Distance processes your personal data in order to conduct ongoing recruitment process for indicated position in Draw Distance, and – if you explicitly and voluntarily give your consent – also for the purposes of future recruitment processes.

Legal basis for processing

Draw Distance processes your personal data on the following legal basis:

1)       point (c) of article 6(1) of GDPR and article 22¹ of Labor Code,

2)       point (a) of article 6(1) of GDPR (consent to the processing of personal data) in case of:

a.        filing candidate’s application which includes personal data outside the scope of article 22¹ of Labor Code, or

b.        giving consent to processing of personal data for the purposes of future recruitment processes.

Scope of personal data

The scope of processed personal data is subject in particular to article 22¹  of Labor Code and implementing rules thereto.

Provision of personal data in the scope specified in article 22¹  of Labor Code and implementing rules there to is a requirement necessary to enter into recruitment process, outside that scope it is voluntarily and requires the explicit consent of the candidate.

Exercising of rights

You have the right to request access to and rectification of your personal data or their erasure in cases provided by law, also restrict processing, object to processing in case of data provided voluntarily and withdraw your consent to their processing at any time, without affecting the lawfulness of processing  based on consent before its withdrawal.  Withdrawal of the consent to processing for purposes of future recruitment processes  after the closure of ongoing recruitment process, will effect in not including the candidate in further recruitment processes.

To exercise the rights specified hereinabove, the request shall be sent to e-mail: contact@drawdistance.dev, by post to the contact address of Draw Distance or in person in Draw Distance’s headquarters. Before exercising your rights, we will have to confirm your identity in a manner appropriate to the request.

In case of finding the processing of personal data by the Draw Distance not coherent with GDPR, then you has the right to lodge a complaint with a supervisory authority, which is President of the Personal Data Protection Office, Stawki 2 street, 00-193 Warszawa.

Recipients of personal data

Your personal data is or may be received by the following recipients in whom Draw Distance vested the processing of personal data on the base of concluded agreements:

·         entities servicing Draw Distance’s devices through which personal data of candidates are processed;

·         providers of recruitment websites or providers  of recruitment management systems (e.g. pracuj.pl)

·         shipping companies through which the correspondence with candidates is conducted.

Draw Distance will not transfer your personal data to a third country or international organization.

Automated decision-making

Draw Distance will not process your personal data in automated decision-making, including profiling.

Period of personal data storing

Your personal data will be processed:

·         for the period necessary to conduct the recruitment process,

·         until the withdrawal of given consent – in case of giving consent for processing personal data in future recruitment processes,

·         for 12 months since the closure of ongoing recruitment process – in case of giving consent for processing personal data in future recruitment processes.
